Terms of Service

1. Agreement

By downloading, installing or using Pulse Messenger (“Pulse”, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. The Service

Pulse provides a privacy‑focused messaging platform with per‑message encryption and device‑based authentication. We continually improve features and may add, change, or remove functionality.

3. Eligibility & Accounts

  • You must be at least 16 years old to use the Service.
  • No phone number or email is required. Your device keys authenticate you.
  • You are responsible for the security of your device and credentials.

4. Acceptable Use

You agree not to, and not to assist others to:

  • Engage in illegal activity or violate rights of others.
  • Harass, abuse, threaten, or impersonate others.
  • Spam or disrupt the Service (e.g., automated abuse, excessive traffic).
  • Reverse engineer, decompile, or circumvent security or rate limits.
  • Upload malicious code or interfere with networks or infrastructure.

5. Content

  • You retain rights to the content you send. You are solely responsible for it.
  • We do not monitor message content and remove transient undelivered items after the retention window.
  • We may remove or restrict content or access that violates these Terms or the law.

6. Security

We implement robust security measures including TLS in transit and per‑message encryption with ratcheting. No system is perfect: you must maintain reasonable security on your device and report issues promptly.

7. Service Availability

The Service may be unavailable for maintenance, upgrades, or for reasons beyond our control. We do not guarantee uninterrupted or error‑free operation.

8. Third‑Party Services

We may use third‑party processors (e.g., EU hosting) under GDPR‑compliant agreements. Their use is limited to operating the Service on our behalf.

9. Intellectual Property

  • Pulse software, logos, and trademarks are owned by us or our licensors.
  • You may not copy, modify, or create derivative works of the Service except as permitted by law.

10. Feedback

If you provide ideas or suggestions, you grant us a non‑exclusive, royalty‑free license to use them to improve the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, misuse the Service, or if required by law. Upon termination, certain provisions (e.g., limitations of liability) survive.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by Dutch law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill arising from your use of the Service.

14. Changes to the Terms

We may revise these Terms. Material changes will be notified in‑app or on the website. Continued use after changes become effective constitutes acceptance.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands. Disputes will be resolved by the competent courts in the Netherlands, without prejudice to mandatory rights under EU consumer law.
